1、2023ProcuratorialWhitePaperonIntellectualPropertyinShanghaiReleasedbyShanghaiPeople,sProcuratorateAstheintellectualproperty(hereinafterreferredtoastheTP)isakeyelementofthenewqualityproductiveforces,theIPprotectionmustbestrengthenedindevelopmentofsuchforces.Atpresent,Shanghaiiswitnessingaccelerationo

2、fconstructionofaninternationalcenterfortechnologyandinnovationaswellasbuildingoftheIPprotectionhighlandandthatofaninternationalIPcentralcity.Theprocuratoratewillperformthehigh-qualityandhigh-efficiencyprocuratorialfunctionstoenablenewachievementsinIPprotectionsothatinnovativevigorcanbemotivatedandan

3、innovativeenvironmentcanbecreated.Today(April23),ShanghaiPeoplesProcuratorateholdsapressconferencetoreleasethe2023ProciiratoraiWhitePaperonIntellectualPropertyinShanghaiintheChineseandEnglishversion.Basedonananalysisofthecriminal,civil,administrative,public-interestIPlitigationcaseshandledbythepropc

4、uratoratesinShanghaiin2023,westudynewchangesandtrendsoccurredintheIPdevelopmentandprotectiontosuggestcounter-measuresandrecommendationsonconsolidationofthecomprehensivejudicialIPprotectionwithaviewtoprovidingpowerfulprocuratorialguaranteeforcultivatinganddevelopingofthenewqualityproductiveforcesaswe

5、llasforse11ingtheinnovation-drivendevelopment.I.BasicSituationoftheIPCasesinShanghaiOVeraHSituation1. TheIP-infringementcrimeisapproachinghistoricalheightandapplicationofthecoercivemeasureswascontinuouslyoptimized.TheprocuratoratesinShanghaitookcognizanceofi,369IP-infringementcriminalcasesinvolving2

6、,81()perpetrators:ThenumberftheIP-IntringcmenlCrimiIHcasesixIbe%unofIbenu11beofllG%elexaninali(MdarrvslandIhalofhccases(orexaminationandpon.Thesamebelow.in2023,including425casesforexaminationandarrestinvolving738perpetratorswherethenumberofcasesandthatofperpetratorsrose144.3%and123.0%respectivelyinc

7、omparisonwiththepreviousyear;aswellas944casesforexaminationandprosecutioninvolving2,072perpetratorswherethenumberofcasesandthatofperpetratorsrose53.2%and49.9%respectivelyincomparisonwiththepreviousyear.Thearrestrateofsuspectswasbasicallythesameasin2022inthattheProC1.IratoraIeSfocusedmoreonaccurateim

8、plementationofthecriminalpolicyofcombiningleniencywithseverity,resultinginstabilizationofthearrestrateapprovedbytheprocuratorates.Theaveragehandlingtimeofthefirst-instanceIPpublicprosecutedcasesinShanghaiwas56.63daysin2023.29.5%wassubstantiallyoptimizedincomparisonwith2022.Comprehensiveexaminationof

9、theIPcaseswasstrengthened,leadingtoprosecutionof20personsonsuspicionoftheIPinfringementinothercriminalcases.Intermsoftheeffectivejudgmentsrenderedbythecourt,thosewhoweresentencedtominimumthree-yearfixed-termimprisonmentaccountedfor43.9%,indicatingstrengtheningoftheproperty-relatedpenalty.2. Signific

10、antchangesintheIP-infringementcriminalstructure.Firstly,althoughthenumberofthetrademarkinfringementcasesstillrankedthetopincriminalcases,itsproportionfurtherdroppedto88.8%.Amongotherthings,therewere873casesofsellingcommoditywithcounterfeitregisteredtrademarksinvolving1,579perpetrators,rankingthetopi

11、nvarioustrademark-infringementcharges.Therewerealso298casesofcounterfeitingregisteredtrademarksinvolving744perpetratorsand45casesofillegalmanufactureandsalesofillegallyproducedregisteredtrademarksandlogosinvolving124perpetratorsSecondly,thequantityrelativeratioofthecopyright-infringementcasesroseuna

12、nimously,accountingfor9.4%from5.3%in2022incriminalcases.Amongotherthings,therewere105casesofcopyrightinfringementinvolving261perpetrators,thenumberofwhichroseby1.8timesincomparisonwith2022.Therewere24casesofsalesofpiratecopiesinvolving46perpetrators,thenumberofwhichrosebyfivetimesincomparisonwith202

13、2.Thirdly,casesofinfringementofbusinesssecretswereontherise,accountingfor1.8%incriminalcases.Therewere24casesofinfringementofbusinesssecretsinvolving56perpetrators,thenumberofwhichroseby60%incomparisonwith2022.Thefirstcaseofillegalspyingandprovisionofbusinesssecretsforoverseasorganizationswashandled

14、inShanghaiasofimplementationoftheAmendments(XI)totheCriminal1.aw.Changesinthecriminalstructurewerecausedby,ononehand,frequentoccurrenceofnew-typecasessuchasthecopyrightandthebusinesssecretinfringementresultedfromincreasingdevelopmentintheneweconomyandhightechnology;ontheotherhand,improvementinthejud

15、icialorganspowerfullyprofessionalcapabilitiesofcrackingandhandlingofcasesaswellasgradualmanifestationofachievementsintheservicesforscienceandtechnologyinnovationcentersandtheculturalprosperityandinnovation.3. Deeperfulfillmentofthelegalsupervisionofthecriminalproceedings.Pre-interventioninthefronten

16、dofhardcaseswasfullyimplementedaimingatthefeaturesoftheIP-infringementcriminalcases,i.e.easilyperishableevidenceandtimelinessofevidencecollection.Relyingonmechanismsincludingtheofficeofinvestigationsupervisionandcollaboration,wesupervisedregistrationof283casesaswellaspursuitandprosecutionof213perpetrators,72ofwhomweresentencedtominimumthree-yearfixed-termimprisonment.Transferof52casesonsuspicionoftheIPinfringementtothepolicebytheadministrativeauth
