1、2023ProcuratorialWhitePaperonIntellectualPropertyinShanghaiReleasedbyShanghaiPeople,sProcuratorateAstheintellectualproperty(hereinafterreferredtoastheTP)isakeyelementofthenewqualityproductiveforces,theIPprotectionmustbestrengthenedindevelopmentofsuchforces.Atpresent,Shanghaiiswitnessingaccelerationo

2、fconstructionofaninternationalcenterfortechnologyandinnovationaswellasbuildingoftheIPprotectionhighlandandthatofaninternationalIPcentralcity.Theprocuratoratewillperformthehigh-qualityandhigh-efficiencyprocuratorialfunctionstoenablenewachievementsinIPprotectionsothatinnovativevigorcanbemotivatedandan

3、innovativeenvironmentcanbecreated.Today(April23),ShanghaiPeoplesProcuratorateholdsapressconferencetoreleasethe2023ProciiratoraiWhitePaperonIntellectualPropertyinShanghaiintheChineseandEnglishversion.Basedonananalysisofthecriminal,civil,administrative,public-interestIPlitigationcaseshandledbythepropc

4、uratoratesinShanghaiin2023,westudynewchangesandtrendsoccurredintheIPdevelopmentandprotectiontosuggestcounter-measuresandrecommendationsonconsolidationofthecomprehensivejudicialIPprotectionwithaviewtoprovidingsubstantiallyoptimizedincomparisonwith2022.ComprehensiveexaminationoftheIPcaseswasstrengthen

5、ed,leadingtoprosecutionof20personsonsuspicionoftheIPinfringementinothercriminalcases.Intermsoftheeffectivejudgmentsrenderedbythecourt,thosewhoweresentencedtominimumthree-yearfixed-termimprisonmentaccountedfor43.9%,indicatingstrengtheningoftheproperty-relatedpenalty.2. SignificantchangesintheIP-infri

6、ngementcriminalstructure.Firstly,althoughthenumberofthetrademarkinfringementcasesstillrankedthetopincriminalcases,itsproportionfurtherdroppedto88.8%.Amongotherthings,therewere873casesofsellingcommoditywithcounterfeitregisteredtrademarksinvolving1,579perpetrators,rankingthetopinvarioustrademark-infri

7、ngementcharges.Therewerealso298casesofcounterfeitingregisteredtrademarksinvolving744perpetratorsand45casesofillegalmanufactureandsalesofillegallyproducedregisteredtrademarksandlogosinvolving124perpetratorsSecondly,thequantityrelativeratioofthecopyright-infringementcasesroseunanimously,accountingfor9

8、.4%from5.3%in2022incriminalcases.Amongotherthings,therewere105casesofcopyrightinfringementinvolving261perpetrators,thenumberofwhichroseby1.8timesincomparisonwith2022.Therewere24casesofsalesofpiratecopiesinvolving46perpetrators,thenumberofwhichrosebyfivetimesincomparisonwith2022.Thirdly,casesofinfrin

9、gementofbusinesssecretswereontherise,accountingfor1.8%incriminalcases.Therewere24casesofinfringementofbusinesssecretsinvolving56perpetrators,thenumberofwhichroseby60%incomparisonwith2022.ThefirstcaseofillegalspyingandprovisionofbusinesssecretsforoverseasorganizationswashandledinShanghaiasofimplement

10、ationoftheAmendments(XI)totheCriminal1.aw.Changesinthecriminalstructurewerecausedby,ononehand,frequentoccurrenceofnew-typecasessuchasthecopyrightandthebusinesssecretinfringementresultedfromincreasingdevelopmentintheneweconomyandhightechnology;ontheotherhand,improvementinthejudicialorganspowerfullypr

11、ofessionalcapabilitiesofcrackingandhandlingofcasesaswellasgradualmanifestationofachievementsintheservicesforscienceandtechnologyinnovationcentersandtheculturalprosperityandinnovation.3. Deeperfulfillmentofthelegalsupervisionofthecriminalproceedings.Pre-interventioninthefrontendofhardcaseswasfullyimp

12、lementedaimingatthefeaturesoftheIP-infringementcriminalcases,i.e.easilyperishableevidenceandtimelinessofevidencecollection.Relyingonmechanismsincludingtheofficeofinvestigationsupervisionandcollaboration,wesupervisedregistrationof283casesaswellaspursuitandprosecutionof213perpetrators,72ofwhomweresent

13、encedtominimumthree-yearfixed-termimprisonment.Transferof52casesonsuspicionoftheIPinfringementtothepolicebytheadministrativeauthoritieswassuggested.50ofwhichwasregisteredforinvestigation.Twocriminalcaseswereprotested.Judgmentagainstoneofthemwasamended.4. Solidprogressesweremadeincivilandadministrati

14、veIPsupervisionandtheIPpublic-interestlitigationwassteadilyexpanded.Therewere28civilsupervisioncasesincludingtwocaseswhereprocuratorialsuggestionsonarelrialweremadeand15caseswhereprocuratorialsuggestionsonrectificationofviolationofthelawweremade.Moreover,thereweretwocasesinvolvingSUPerViSiOnofnon-li

15、tigationadministrativeenforcementwhereprocuratorialsuggestionsonrectificationofviolationofthelawwerebothmade.Inaddition,therewere17IPpublic-interestlitigationcasesincluding11civilcasesandsixadministrativeones.Pre-Iitigationprocuratorialsuggestionsweremadeinfivecaseswheretheadministrativeauthoritiesh

16、avealltakenrectificationmeasuresandperformeddutiesinaccordancewiththelaw.5. ComprehensiveperformanceofprocuratorialfunctionsintheIPrealmwasfullydeepened,featuringincreasinglydiversemeans.Thecomprehensiveprocuratorialfunctionswereperformedinhandlingof129casesbytheprocuratoratesinShanghai,including115casesreverselytransferredtoadministrativeauthoritiesforpunishmentafternolleprosequi,11casesofincidentalcivilactions,twoprosecution-supportedcasesandtwocasesofpublic-interestadmin
