工程合同中有关开工的条款中英文对照全套工程合同中有关开工的条款COMMENCEMENTOFWORK开工CommencementofWork开工准备CommencementPreparation开工通矢口CommencementNotice开工日期CommencementDate开工时间TimeforCommencement开工及延期开工Commencementandpostponementofcommencement开工日期：指双方在协议书中约定，乙方开始施工的绝对或相对的日期。Commencingdate:thedate,absoluteorrelative,onwhichPartyBstartsthestipulatedconstructionagreedbybothpartiesintheagreement.TheCommencementDate:ThedateonwhichtheContractorcommencestheconstructionhereunderasspecifiedintheagreement.开工日期：指发包人承包人在协议书中约定的承包人开始施工的日期。除专用合同条款另有约定外，承包人应按照第7.1款施工组织设计约定的期限，向监理人提交工程开工报审表，经监理人报发包人批准后执行。开工报审表应详细说明按施工进度计划正常施工所需的施工道路、临时设施、材料、工程设备、施工设备、施工人员等落实情况以及工程的进度安排。Unlessotherwisespecifiedinthetermsoftheparticularcontract,thecontractorshallsubmittothesupervisorthereportformofconstructioncommencementinaccordancewiththetermstipulatedinsubclause7.1ConstructionOrganizationDesign.Thereportformshallbeexecutedsubsequenttotheemployersapproval.Thereportformofcommencementshouldmakeillustrationsoftheimplementationontheworkroad,temporaryfacilities,materials,engineeringequipment,constructionequipmentconstructionpersonnel,etc.,whicharenecessaryforconstructionprogressplanzandthescheduleoftheworksprogress.除专用合同条款另有约定外，合同当事人应按约定完成开工准备工作。Exceptotherwiseagreementofcontract,partiesheretoshouldpursuanttotheagreementaccomplishthepreparationofcommencement.发包人应按照法律规定获得工程施工所需的许可。经发包人同意后，监理人发出的开工通知应符合法律规定。监理人应在计划开工日期7天前向承包人发出开工通知，工期自开工通知中载明的开工日期起算。Theemployershall,inaccordancewiththestipulationsoflaw,obtainthenecessarypermissionandapprovalfortheconstructionoftheworks.TheCommencementNoticeissuedbythesupervisorshall,subjecttotheemployer7sapprovalandcomplywiththestipulationsoflaw.Thesupervisorshall,7dayspriortothescheduledcommencementdateandtheworktermwillbecalculatedfromthecommencementdatewhichisstatedinCommencementNotice.除专用合同条款另有约定外，因发包人原因造成监理人未能在计划开工日期之日起90天内发出开工通知的，承包人有权提出价格调整要求，或者解除合同。发包人应当承担由此增加的费用和（或）延误的工期，并向承包人支付合理利润。Unlessotherwisespecifiedintheparticularcondition,wherethesupervisorfailstoissueCommencementNoticeduetotheemployer7reason,within90daysfromthescheduledcommencementdate,thecontractorreservetherighttoraisetherequirementofpriceadjugementorterminationofcontract.Employershouldbeartheincreasedcostand/ordelayedtermarisingtherefrominadditiontomakepaymentofreasonableprofitstothecontractor.除非合同协议书另有说明，雇主应在不少于7天前向承包商发出开工日期的通知；UnlessotherwisestatedintheContractAgreement,theEmployershallgivetheContractornotlessthan7days,noticeoftheCommencementDate;and开工日期应在第L6款合同协议书规定的合同全面实施和生效日期后42天内。theCommencementDateshallbewithin42daysafterthedateonwhichtheContractcomesintofullforceandeffectunderSub-Clause1.6ContractAgreement.承包商应在开工日期后,在合理可能情况下尽早开始工程的设计和施工,随后应以正当速度拖延地进行工程。TheContractorshallcommencethedesignandexecutionoftheWorksassoonasisreasonablypracticableaftertheCommencementDate,andshallthenproceedwiththeWorkswithdueexpeditionandwithoutdelay.开工日期指的是钻机到达公司的第一口井井场或指定的其它井场，承包商各个岗位人员齐备，从各方面都已具备开钻水平，并在以下规定的合同期间内，以钻机制造商标定的技术规范，达到能够进行持续施工状态的时刻。钻机一旦到达井场，承包商应立即以书面形式通知公司。"CommencementDate"meansthedateandtimeofarrivaloftheRigatthefirstwellorotherlocationspecifiedbyCOMPANY,providedCONTRACTOR'Sfullcrewisinallrespectsreadytospudandsustaincontinueddrillingoperationsatmanufacturer'sratedspecificationduringtheContractPeriodasdefinedbelow.CONTRACTORshallnotifyCOMPANYinwritingimmediatelyupontheRig'sarrival.发包人必须按合同规定支付定金，收到定金作为设计人设计开工的标志。未收到定金，设计人有权推迟设计工作的开工时间，且交付文件的时间顺延。TheemployershallpaythedownpaymentinaccordancewithstipulationsoftheContract.Receptionofthedownpaymentisthemarkofcommencementofdesignworkforthedesigner.Ifthedownpaymentisnotreceived,thedesignerisentitledtoputoffthetimeofcommencementofdesignworkzandpostponeaccordinglythetimeofdeliveryofdocuments.乙方应当按照协议书约定的开工日期开工。乙方不能按时开工，应当不迟于协议书约定的开工日期前7天，以书面形式向甲方代表提出延期开工的理由和要求。甲方代表应当在接到延期开工申请后48小时内以书面形式答复乙方。PartyBshallcommencetheconstructionaspertheagreement.Incasethecommencementcannotbeontimezthecommencementshallnotbelaterthan7daysthantheagreeddateandthepostponementshallbeexplainedtoPartyAsrepresentativeandrequestedinwriting,whoshallgiveawrittenreplytoPartyBwithin48hoursuponreceipt.Incasenoreplyismadewithin48hours,itshallberegardedPartyAsrepresentativehasagreedonthepostponementandtheprogressscheduleshallbepostponedaccordingly.IfPartyAsrepresentativedoesnotagreeonthepostponementorPartyBfailstosubmitarequestforpostponementwithinthestipulatedperiod,theconstructionperiodshallnotbepostponed.承包人应当按照协议书约定的开工日期开工。承包人不能按时开工，应当不迟于协议书约定的开工日期前4天，以书面形式向工程师和发包人代表提出延期开工的理由和要求；只有在接到工程师和发包人代表明确的书面答复后，工期才能相应顺延。工程师和发包人代表不同意延期要求或承包人未在规定时间内提出延期开工要求，工期不予顺延。TheContractorshallcommenceconstructionontheCommencementDateasagreedintheAgreement.IftheContractorcannotcommenceontime,theContractorshallsubmittotheEngineersandtheEmployersRepresentativerequirementinwritingfordeferringthecommencementwiththenecessaryreasonsnotlaterthan4daysbeforetheCommencementDateassetoutintheAgreement.TheProjectPeriodcanbeextendedaccordinglyonlyafterthewrittenexplicitapprovalisobtainedfromtheEngineersandtheEmpIoyer
