【制定机关】 【发文字号】 【公布日期】 【施行日期】 【效力位阶】 【法规类别】中国公民收养子女登记办法（1999年5月12日国务院批准 1999年5月25日民政部令第14 号发布根据2019年3月2日国务院关于修改部分行政法 规的决定第一次修订根据 2023年7月20日国务院关于 修改和废止部分行政法规的决 定第二次修订）第一条为了规范收养登 记行为，根据中华人民共和国 民法典（以下简称民法典）， 制定本办法。第二条中国公民在中国中国公民收养子女登记办法（2023修订）MeasuresforRegistrationofAdoptionofChildrenbyChineseCitizens(2023Revision)国务院中华人民共和国国务院令第764号2023.07.202023.07.20行政法规赡养抚养收养Issuingauthority：StateCouncilDocumentNumber：OrderNo.764oftheStateCouncilofthePeople'sRepublicofChinaDateissued：07-20-2023Effectivedate：07-20-20231.evelofAuthority：AdministrativeRegulationsAreaofLaw：Marriage,FamilySupport,Adoption,andInheritanceMeasuresforRegistrationofAdoptionofChildrenbyChineseCitizens(approvedbytheStateCouncilonMay12,1999;promulgatedbyOrderNo.14oftheMinistryofCivilAffairsonMay25,1999;revisedforthefirsttimeinaccordancewiththeDecisionoftheStateCounciltoAmendCertainAdministrativeRegulationsonMay25,1999;andrevisedforthesecondtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonJuly20,2023)Article1TheseMeasuresareformulatedinaccordancewiththeCivilCodeofthePeople'sRepublicofChina(hereinafterreferredtoastheCivilCode)forthepurposeofstandardizingadoptionregistrationpractice.Article 2 WhereaChinesecitizenadoptsachildorrescindsanadoptiverelationshipbyagreementwithintheChineseterritory,registrationshallbecarriedoutinaccordancewiththeprovisionsoftheseMeasures.Theorgansthathandlesadoptionregistrationisthecivilaffairsdepartmentofthepeople'sgovernmentatthecountylevel.Article 3 TheadoptionregistrationworkshalladheretotheleadershipoftheCommunistPartyofChina,followtheprincipleofbeingmostbeneficialtoadoptees,andprotectthelawfulrightsandinterestsofadopteesandadoptersArticle4Whereanabandonedinfant,childororphanwhoisrearedbyasocialwelfareinstitutionandwhosebiologicalparentscannotbeidentifiedorfoundisadopted,registrationshallbecarriedoutwiththeadoptionregistrationorganinthelocalitywherethesocialwelfareinstitutionislocated.Whereanabandonedinfantorchildwhoisnotrearedbyasocialwelfareinstitutionandwhosebiologicalparentscannotbeidentifiedorfoundisadopted,registrationshallbecarriedoutwiththeadoptionregistrationorganinthelocalitywheretheabandonedinfantorchildisfound.境内收养子女或者协议解除收 养关系的，应当依照本办法的规 定办理登记。办理收养登记的机关是县级人 民政府民政部门。第三条收养登记工作应 当坚持中国共产党的领导，遵循 最有利于被收养人的原则，保障 被收养人和收养人的合法权益。第四条收养社会福利机 构抚养的查找不到生父母的弃 婴、儿童和孤儿的，在社会福利 机构所在地的收养登记机关办 理登记。收养非社会福利机构抚养的查 找不到生父母的弃婴和儿童的， 在弃婴和儿童发现地的收养登 记机关办理登记。收养生父母有特殊困难无力抚 养的子女或者由监护人监护的 孤儿的，在被收养人生父母或者 监护人常住户口所在地（组织作 监护人的，在该组织所在地）的 收养登记机关办理登记。Whereachildwhosebiologicalparentsareunabletorearitduetounusualdifficultiesoranorphanguardedbyaguardianisadopted,registrationshallbecarriedoutwiththeadoptionregistrationorgansinthelocalitywherethepermanentresidenceoftheadoptee'sbiologicalparentsorguardiansisregistered(whereanorganizationactsasguardian,theninthelocalityofsuchorganization).Whereachildbelongingtocollateralrelativesbybloodofthesamegenerationanduptothethirddegreeofkinshipisadopted,orwhereastepchildisadoptedbyhisorherstepfatherorstepmother,registrationshallbecarriedoutwiththeadoptionregistrationorganinthelocalitywherethepermanentresidenceoftheadoptee,sbiologicalfatherorbiologicalmotherisregistered.Article5Partiesinvolvedinadoptiverelationshipshallappearinpersonbeforeadoptionregistrationorganstogothroughregistrationformalitiestoestablishtheadoptiverelationship.Whereahusbandandhiswifeadoptachildinconcert,registrationformalitiesshallbegonethroughwiththeadoptionregistrationorganbytheminconcert;whereoneofthemcannotappearthereinpersonforsomereasons,heorsheshallentrusttheotheroneinwritingwiththehandlingofregistrationformalities,andthepowerofattorneyshallbecertifiedbythevillagers*committeeorneighborhoodcommitteeorbenotarized.Article6Anadoptershallsubmittotheadoptionregistrationorgananadoptionapplicationandthefollowingcredentialsandcertifyingpapers:(1) theadopter'sresidencebookletandresidentidentitycard;收养三代以内同辈旁系血亲的 子女，以及继父或者继母收养继 子女的，在被收养人生父或者生 母常住户口所在地的收养登记 机关办理登记。第五条收养关系当事人 应当亲自到收养登记机关办理 成立收养关系的登记手续。夫妻共同收养子女的，应当共同 到收养登记机关办理登记手续； 一方因故不能亲自前往的，应当 书面委托另一方办理登记手续， 委托书应当经过村民委员会或 者居民委员会证明或者经过公 证。第六条收养人应当向收 养登记机关提交收养申请书和 下列证件、证明材料：（一）收养人的居民户口簿和居 民身份证；（二）由收养人所在单位或者村 民委员会、居民委员会出具的本 人婚姻状况和抚养教育被收养(2) acertificateissuedbytheemployeroftheadopterorthevillagers*committeeorneighborhoodcommitteeprovinghisorhermaritalstatus,hisorhercapabilitytoraiseandeducatetheadoptee5andotherinformation,andastatementontheinformationonhisorherchildrenprovidedbytheadopter;(3) ahealthexaminationcertificateissuedbyamedicalunitatorabovethecountylevelofnotsufferingsuchadiseaseasismedicallyregardedasunfitforadoptingachild.Whereanabandonedinfantorchildwhosebiologicalparentscannotbeascertainedorfoundisadopted,acertificateofchild-bearingsituationoftheadopterissuedbythehealthdepartmentinthelocalitywherethehabitualresidenceoftheadopterisregisteredshallbesubmitted;whereanabandonedinfantorchildwhoisnotrearedbyasocialwelfareinstitutionandwhosebiological
