国内水路运输管理条例（2012年10月13日中华人民共 和国国务院令第625号公布根 据2016年2月6日国务院关于 修改部分行政法规的决定第一 次修订根据2017年3月1日国务院关于修改和废止部分行 政法规的决定第二次修订根 据2023年7月20日国务院关 于修改和废止部分行政法规的决 定第三次修订）第一章总 则国内水路运输管理条例(2023修订)RegulationontheAdministrationofDomesticWaterTransport(2023Revision)制定机关：国务院发文字号：中华人民共和国国务院令第764号公布日期：2023.07.20施行日期：2023.07.20效力位阶：行政法规法规类别：水上运输IssuingAuthority：StateCouncilDocumentNumber：OrderNo.764oftheStateCouncilofthePRCDateIssued：07-20-2023EffectiveDate：07-20-20231.evelofAuthority：AdministrativeRegulationsAreaofLaw:WaterwayTransportRegulationontheAdministrationofDomesticWaterTransport(PromulgatedbytheOrderNo.625oftheStateCouncilofthePeople'sRepublicofChinaonNovember13,2012;andrevisedforthefirsttimeinaccordancewiththeDecisionoftheStateCouncilonAmendingSomeAdministrativeRegulationsonFebruary6,2016;revisedforthesecondtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonMarch1,2017;andrevisedforthethirdtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonJuly20,2023)ChapterIGeneralProvisionsArticle1ThisRegulationisformulatedforpurposesofregulatingtheoperationofdomesticwatertransport,maintainingthemarketorderofdomesticwatertransport,guaranteeingthesafetyofdomesticwatertransport,andpromotingthesounddevelopmentofdomesticwatertransportcause.Article 2 TheoperationofdomesticwatertransportandancillarybusinessshallbesubjecttothisRegulation.Thetermudomesticwatertransportn(hereinafterreferredtoasuwatertransporf,)asmentionedinthisRegulationreferstothecommercialtransportofpassengersandcargosinnavigablewaters,wherethedepartureport,thecallingport,andthedestinationportareallwithinthejurisdictionofthePeople,sRepublicofChina.Thetermuancillarywatertransportbusiness”asmentionedinthisRegulationreferstothebusinessoperationsthataredirectlyprovidedforwatertransport,suchasvesselmanagement,vesselagency,agencyforwatertransportofpassengers,andagencyforwatertransportofcargos.Article 3 Thestateshallencourageandprotectfaircompetitionatthewatertransportmarketandprohibitmonopolyandunfaircompetition.第一条为了规范国内水路 运输经营行为，维护国内水路运 输市场秩序，保障国内水路运输 安全，促进国内水路运输业健康 发展，制定本条例。第二条经营国内水路运输 以及水路运输辅助业务，应当遵 守本条例。本条例所称国内水路运输（以下 简称水路运输），是指始发港、 挂靠港和目的港均在中华人民共 和国管辖的通航水域内的经营性 旅客运输和货物运输。本条例所称水路运输辅助业务， 是指直接为水路运输提供服务的 船舶管理、船舶代理、水路旅客 运输代理和水路货物运输代理等 经营活动。第三条国家鼓励和保护水 路运输市场的公平竞争，禁止垄 断和不正当竞争行为。国家运用经济、技术政策等措 施，支持和鼓励水路运输经营者 实行规模化、集约化经营，促进 水路运输行业结构调整；支持和 鼓励水路运输经营者采用先进适 用的水路运输设备和技术，保障Byadoptingsuchmeasuresaseconomicandtechnicalpolicies,thestateshallsupportandencouragewatertransportoperatorstorealizescaleandintensivebusinessoperationsandpromotethestructuraladjustmentofthewatertransportindustry;andsupportandencouragewatertransportoperatorstoadoptadvancedandapplicablewatertransportfacilitiesandtechnologiestoguaranteetransportsafety,promoteenergyconservation,andreducepollutantdischarge.Thestateshallprotectthelawfulrightsandinterestsofwatertransportoperators,passengers,andcargoowners.Article 4 ThetransportadministrativedepartmentoftheStateCouncilshallbeinchargeofthenationalwatertransportmanagement.Thetransportadministrativedepartmentunderthelocalpeople'sgovernmentatorabovethecountylevelshallbeinchargeofthewatertransportmanagementwithintheirrespectivejurisdiction.Thedepartmentorinstitutionresponsibleforwatertransportmanagementunderthelocalpeople'sgovernmentatorabovethecountylevel(hereinafterreferredtoas“departmentresponsibleforwatertransportmanageme)shallundertakethewatertransportmanagementassetforthinthisRegulation.Article 5 Toengageinwatertransportandancillarybusiness,anoperatorshallobservelawsandregulationsandprovideservicesingoodfaith.运输安全，促进节约能源，减少 污染物排放。国家保护水路运输经营者、旅客 和货主的合法权益。第四条 国务院交通运输主 管部门主管全国水路运输管理工 作。县级以上地方人民政府交通运输 主管部门主管本行政区域的水路 运输管理工作。县级以上地方人 民政府负责水路运输管理的部门 或者机构（以下统称负责水路运 输管理的部门）承担本条例规定 的水路运输管理工作。第五条经营水路运输及其 辅助业务，应当遵守法律、法 规，诚实守信。国务院交通运输主管部门和负责 水路运输管理的部门应当依法对 水路运输市场实施监督管理，对 水路运输及其辅助业务的违法经 营活动实施处罚，并建立经营者ThetransportadministrativedepartmentoftheStateCouncilandthedepartmentresponsibleforwatertransportmanagementshallconductsupervisionandadministrationonthewatertransportmarketaccordingtolaw,imposepenaltiesagainstanyillegalwatertransportoperationandanc川arybusiness,establishmanagementrulesforoperator'soperationsingoodfaith,andpubliclyannouncethesupervisionandinspectioncircumstancesinatimelymanner.ChapterIlWaterTransportOperatorsArticle6Toapplyforengaginginwatertransportbusiness,besidesthecircumstancesasprescribedinArticle7ofthisRegulation,anapplicantshallsatisfythefollowingconditions:(1) obtainsthelegalpersonstatusasanenterprise;(2) hasvesselsthatsatisfytheconditionsasprescribedinArticle13ofthisRegulation,andthetransportcapacityofitsownvesselsconformstotheprovisionsofthetransportadministrativedepartmentoftheStateCouncil;(3) hasspecificbusinessscope.Wheretheapplicantappliesforwatertransportbusinessofpassengerliners,itshallhavefeasiblerouteoperationplan;(4) hasthemanagementpersonnelofmaritimeandmechanicalaffa
