上海市人民代表大会常务委员会公 告（十六届）第三号）上海市野生动物保护条例已由 上海市第十六届人民代表大会常务 委员会第三次会议于2023年6月20 日通过，现予公布，自2023年10 月1日起施行。上海市人民代表大会常务委员会45097上海市野生动物保护条例（2023年6月20日上海市第十六届 人民代表大会常务委员会第三次会 议通过）第一章总则上海市野生动物保护条例RegulationsofShanghaiMunicipalityonWildAnimalConservation制定机关：上海市人大(含常委会)发文字号：上海市人民代表大会常务委员会公告16届第3号公布日期：2023.06.20施行日期：2023.10.01效力位阶：省级地方性法规法规类别：野生动植物资源IssuingAuthority：ShanghaiMunicipalityPeople'sCongress(incl.StandingCommittee)DocumentNumber：AnnouncementNo.3oftheStandingCommitteeofthe16thShanghaiMunicipalPeople'sCongressDateIssued：06-20-2023EffectiveDate：10-01-20231.evelofAuthority：ProvincialLocalRegulationsAreaofLaw：WildlifeResourcesAnnouncementoftheStandingCommitteeofShanghaiMunicipalPeople'sCongressNo.3RegulationsofShanghaiMunicipalityonWildAnimalConservationwereadoptedatthe3rdSessionoftheStandingCommitteeofthe16thShanghaiMunicipalPeople'sCongressonJune20,2023,areherebypromulgated.TheyshallbeeffectiveasofOctober1,2023.StandingCommitteeofShanghaiMunicipalPeople'sCongress45097RegulationsofShanghaiMunicipalityonWildAnimalConservation(Adoptedatthe3rdSessionoftheStandingCommitteeofthe16thShanghaiMunicipalPeople'sCongressonJune20,2023)Chapter I GeneralProvisions第一条 为了保护野生动物， 拯救珍贵、濒危野生动物，维护生 物多样性和生态平衡，推进生态文 明建设，促进人与自然和谐共生， 根据中华人民共和国野生动物保 护法等有关法律、行政法规的规 定，结合本市实际，制定本条例。第二条在本市行政区域内从 事野生动物保护及相关活动，适用 本条例。本条例规定保护的野生动物，包括 经国务院批准公布的国家重点保护 野生动物，国务院野生动物保护主 管部门公布的有重要生态、科学、 社会价值的陆生野生动物，以及市 人民政府公布的地方重点保护野生 动物。本条例规定的野生动物及其制品， 是指野生动物的整体（含卵、蛋）、 部分及衍生物。珍贵、濒危的水生野生动物以外的 其他水生野生动物的保护，适用中 华人民共和国渔业法等有关法律 的规定。第三条野生动物保护工作遵 循保护优先、规范利用、严格监管、 社会共治的原则，加强重要生态系 统保护和修复，鼓励和支持开展野 生动物科学研究与应用，秉持生态 文明理念，推动绿色发展。Article1Withaviewtoconservingwildanimals,savingrareandendangeredspeciesofwildanimals,maintainingbiologicaldiversityandecologicalbalance,advancingecologicalcivilization,andpromotingtheharmoniousco-existencebetweenhumanityandnature,theseRegulationsareformulatedinaccordancewiththeWildAnimalConservationLawofthePeople'sRepublicofChinaandotherrelevantlawsandadministrativerulesandinthelightoftheactualcircumstancesofthisMunicipality.Article2TheseRegulationsshallapplytotheconservationofwildanimalsandassociatedactivitieswithintheadministrativeareaofthisMunicipality.ThewildanimalsunderconservationprescribedintheseRegulationsincludethewildanimalsunderstatepriorityconservationapprovedandpublishedbytheStateCouncil,theterrestrialwildanimalsofsignificantecological,scientificorsocialvaluepublishedbythecompetentdepartmentofwildanimalconservationoftheStateCouncil(hereinaftertheuwildanimalconservationdepartmen),andthewildanimalsunderlocalpriorityconservationpublishedbytheMunicipalPeople'sGovernment.“WildanimalsandtheirProdUCts“intheseRegulationsmeanthewhole(includingspawnsandeggs),thepartsandderivativesofwildanimals.TheconservationofaquaticwildanimalsotherthantherareandendangeredspeciesofaquaticwildanimalsshallbegovernedbytheFisheriesLawofthePeople'sRepublicofChinaandotherrelevantlaws.Article3Theconservationofwildanimalsshallfollowtheprinciplesofconservationfirst,regulatedutilization,stringentsupervisionandjointsocialgovernance0,strengthentheprotectionandrestorationofimportantecosystems,encourageandsupportscientificresearchandapplicationofwildanimals,upholdthephilosophyofecologicalcivilization,andpromotegreendevelopment.Article4Themunicipalanddistrictpeople'sgovernmentsshallstrengthentheirleadershipoverthewildanimalconservationwork,drawupplanningandmeasuresforconservingwildanimalsandtheirhabitats,andincludethewildanimalconservationexpensesintheirbudgets.Article5Thedepartmentsofforestryandagricultureandruralaffairs(hereinaftercollectivelyreferredtoasthe,wildanimalconservationdepartmen)shallbeinchargeoftheconservationofterrestrialandaquaticwildanimalswithintheirrespectiveadministrativeareas.Thedepartmentsofdevelopmentandreform,marketregulation,publicsecurity,transport,planningandresources,ecologyandenvironment,wateraffairs(ocean),education,postaladministration,urbanmanagementandlawenforcement,etc.shall,accordingtothedivisionoftheirfunctions,takechargeoftheconservationofwildanimals.Article6Conservationofwildanimalsandtheirhabitatsisthecommonresponsibilityofthewholesociety.Itisprohibitedtoillegallyhunt,catch,transportortradeinwildanimalsortoengageinotherprohibitedacts.Itisprohibitedtodestroythehabitatsofwildanimals.Allorganizationsandindividualsshallconscientiouslyobservethestateandmunicipallawsandrulesonwildanimalconservation,enhancetheirawarenessofconservingwildanimalsandsafeguardingpublichealthsafety,preventthespreadofwildanimal-borneinfectiousdiseases,resistillegaleatingofwildanimals,andcultivateacivilizedandhealthylifestyle.第四条市、区人民政府应当 加强对野生动物保护工作的领导， 制定野生动物及其栖息地相关保护 规划和措施，将野生动物保护经费 纳入预算。第五条 林业部门、农业农村 部门（以下统称“野生动物保护主 管部门”）分别主管本行政区域内 陆生、水生野生动物保护工作。发展改革、市场监管、公安、交通、 规划资源、生态环境、水务（海洋）、 教育、邮政和城管执法等部门按照 职责分工，负责野生动物保护相关 工作。第六条保护野生动物及其栖 息地是全社会的共同责任。禁止违 法猎捕、运输、交易野生动物以及 从事法律法规规定的其他禁止性行 为，禁止破坏野生动物栖息地。任何组织和个人应当自觉遵守国家 和本市野生动物保护法律法规，增 强保护野生动物和维护公共卫生安 全的意识，防止野生动物源性传染 病传播，抵
