【制定机关】 【发文字号】 【公布日期】 【施行日期】 【效力位阶】 【法规类别】中华人民共和国道路运输条 例（2004年4月30日中华人民 共和国国务院令第406号公 布根据2012年11月9日国务院关于修改和废止部 分行政法规的决定第一次修 订根据2016年2月6日国 务院关于修改部分行政法规 的决定第二次修订根据 2019年3月2日国务院关 于修改部分行政法规的决定 第三次修订根据2022年3 月29日国务院关于修改和 废止部分行政法规的决定第 四次修订根据2023年7月 20日国务院关于修改和废 止部分行政法规的决定第五 次修订）中华人民共和国道路运输条例(2023修订)RegulationofthePeople1SRepublicofChinaonRoadTransport(2023Revision)国务院中华人民共和国国务院令第764号2023.07.202023.07.20行政法规交通运输综合规定Issuingauthority：StateCouncilDocumentNumber：OrderNo.764oftheStateCouncilofthePRCDateissued：07-20-2023Effectivedate：07-20-2023I,evelofAuthority：AdministrativeRegulationsAreaofLaw：TrafficandTransportRegulationofthePeople'sRepublicofChinaonRoadTransport(PromulgatedbyOrderNo.406oftheStateCouncilofthePeople'sRepublicofChinaonApril30,2004,revisedforthefirsttimeinaccordancewiththeDecisionoftheStateCouncilonAmendingandRepealingSomeAdministrativeRegulationsonNovember9,2012;revisedforthesecondtimeinaccordancewiththeDecisionoftheStateCouncilonAmendingCertainAdministrativeRegulationsonFebruary6,2016;revisedforthethirdtimeinaccordancewiththeDecisionoftheStateCounciltoAmendCertainAdministrativeRegulationsonMarch2,2019;revisedforthefourthtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonMarch29,2022;andrevisedforthefifthtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonJuly20,2023)ChapterIGeneralProvisionsArticle 1 ThisRegulationisformulatedtomaintaintheorderofroadtransportmarket,ensurethesafetyofroadtransport,protectthelegitimaterightsandinterestsofallpartiesinvolvedinroadtransportandpromotethehealthydevelopmentofroadtransport.Article 2 AnyoneengaginginroadtransportbusinessandotheroperationsrelatingtoroadtransportshallabidebythisRegulation.Theterm,roadtransportbusiness*asmentionedintheprecedingparagraphshallincludebusinessofroadpassengertransportandbusinessofroadfreighttransport.Theterm"otheroperationsrelatingtoroadtransport"shallincludethebusinessoperationsofstations(yard),businessoperationsofmotorvehiclemaintenance,andmotorvehicledrivertraining.Article 3 Theprincipleoflawfuloperation,honestyandgoodfaith,andfaircompetitionshallbeobservedbyallthoseengagingintheroadtransportbusinessandotheroperationsrelatingtoroadtransport.Article 4 Theroadtransportadministrationshallbeconsistentwiththeprincipleoffairness,impartiality,opennessandfacilitatingthepeople.第一章总 则第一条为了维护道路 运输市场秩序，保障道路运输 安全，保护道路运输有关各方 当事人的合法权益，促进道路 运输业的健康发展，制定本条 例。第二条从事道路运输 经营以及道路运输相关业务 的，应当遵守本条例。前款所称道路运输经营包括 道路旅客运输经营（以下简称 客运经营）和道路货物运输经 营（以下简称货运经营）；道 路运输相关业务包括站（场） 经营、机动车维修经营、机动 车驾驶员培训。第三条从事道路运输 经营以及道路运输相关业务， 应当依法经营，诚实信用，公 平竞争。第四条道路运输管理， 应当公平、公正、公开和便民。第五条国家鼓励发展 乡村道路运输，并采取必要的Article 5 ThestateshallencouragethedevelopmentofruralroadtransportandGhaIltknacaaaarvmGrtnnrmanytowns,townshipsandadministrativevillagesaspossibletohavebusessoastosatisfythelivingandproductionneedsofthefarmers.Article 6 TheStateencouragesroadtransportenterprisestoengageinlarge-scalebutintensivebusinessoperations.Noentityorindividualmayblockadeormonopolizetheroadtransportmarket.措施提高乡镇和行政村的通 班车率，满足广大农民的生活 和生产需要。第六条国家鼓励道路 运输企业实行规模化、集约化 经营。任何单位和个人不得封 锁或者垄断道路运输市场。第七条国务院交通运 输主管部门主管全国道路运 输管理工作。Article 7 ThetransportdepartmentoftheStateCouncilshalltakechargeofroadtransportadministrationnationwide.Thetransportdepartmentofthelocalpeople'sgovernmentatorabovethecountylevelshallberesponsibleforroadtransportadministrationwithinitsadministrativeregion.ChapterIlRoadTransportBusinessOperationSectionIPassengerTransportArticle8Anyonewhowishestoengageinthepassengertransportbusinessshall:县级以上地方人民政府交通运输主管部门负责本行政区域的道路运输管理工作。第二章道路运输经营第一节客运第八条申请从事客运经营的，应当具备下列条件：a.havevehiclesthatcanmeetthedemandofitsbusinessoperationsandthatarefoundtobequalifiedupontest;（一）有与其经营业务相适应并经检测合格的车辆；b.havedriversthatmeettherequirementsasdescribedinArticle9ofthisRegulation;and（二）有符合本条例第九条规定条件的驾驶人员；c.havesoundrulesandbylawsregardingsafeoperations.（三）有健全的安全生产管理制度。AnyonewhowishestoengageinroutePassenqertransportbusinessoperations申请从事班线客运经营的，还应当有明确的纬路和油占方案。第九条从事客运经营 的驾驶人员，应当符合下列条 件：（一）取得相应的机动车驾驶 证；（二）年龄不超过60周岁；（三）3年内无重大以上交通 责任事故记录；（四）经设区的市级人民政府 交通运输主管部门对有关客 运法律法规、机动车维修和旅 客急救基本知识考试合格。第十条申请从事客运 经营的，应当依法向市场监督 管理部门办理有关登记手续 后，按照下列规定提出申请并 提交符合本条例第八条规定 条件的相关材料：（一）从事县级行政区域内和 毗邻县行政区域间客运经营 的，向所在地县级人民政府交 通运输主管部门提出申请；（二）从事省除市口示且阮shallprovideaplanwithclearroutesandstops.Article9Adriverwhoisengagedinthepassengertransportbusinessoperationsshall:a. haveobtainedacorrespondingmotorvehicledrivingpermit;b. havenotattainedtheageof60years;c. havenorecordofserioustrafficaccidentswithintherecentthreeyears;andd. havepassedthebasicknowledgeexaminationofrelevantpassengertransportlawsandregulations,motorvehiclemaintenance,andfirstaidtopassengers,asheldbythetransportdepartmentofthepeople'sgovernmentatthedistrictedcitylevel.Article10Forbeingengagedinthepassen
