长江河道采砂管理条例（2001年10月25日中华人 民共和国国务院令第320号 公布根据2023年7月20 日国务院关于修改和废止 部分行政法规的决定修 订）第一条为了加强长江 河道采砂管理，维护长江河 势稳定，保障防洪和通航安 全，制定本条例。长江河道采砂管理条例(2023修订)RegulationsonAdministrationofSandExcavationintheCoursesoftheYangtzeRiver(2023Revision)制定机关：国务院发文字号：中华人民共和国国务院令第764号公布日期：2023.07.20施行日期:2023.07.20效力位阶：行政法规法规类别：水利综合规定IssuingAuthority：StateCouncilDocumentNumber：OrderNo.764oftheStateCouncilofthePeople'sRepublicofChinaDateIssued：07-20-2023EffectiveDate：07-20-20231.evelofAuthority：AdministrativeRegulationsAreaofLaw：GeneralProvisionsonWaterConservancyRegulationsonAdministrationofSandExcavationintheCoursesoftheYangtzeRiver(PromulgatedbytheOrderNo.320oftheStateCouncilofthePeople'sRepublicofChinaonOctober25,2001;RevisedinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonJuly20,2023)Article1TheseRegulationsareformulatedforthepurposesofstrengtheningadministrationofsandexcavationinthecoursesoftheYangtzeRiver,maintainingthestabilityoftheYangtzeRiverandsafeguardingfloodprotectionandnavigation.Article2TheactivitiesofsandexcavationinthemainrivercoursesbelowYibinSectionoftheYangtzeRiver(hereafterreferredtoasthesandexcavationintheYangtzeRiver),andtheadministrativeactivitiesthereofshallconformtotheseRegulations.Article3ThecompetentwateradministrativedepartmentandtheYangtzeRiverConservancyCommissionunderitshallenhanceunifiedadministrationandsupervisionofthesandexcavationintheYangtzeRiveranddowelltheworkofrelevantorganization,coordinationandguidance.Theresponsibilitysystembytheadministrativeheadsofthelocalpeople'sgovernmentsispracticedforadministrationofthesandexcavationintheYangtzeRiver.Thelocalpeople,sgovernmentsatoratorabovethecountylevelalongtheRivershallstrengthenadministrationofactivitiesofthesandexcavationintheYangtzeRiverwithintheirrespectiveadministrativeareas,anddowelltheworkoforganization,coordinationandsupervisionofthesandexcavationintheYangtzeRiver.Thecompetentwateradministrativedepartmentsofthelocalpeople'sgovernmentsatorabovethecountylevelalongtheRiverareinchargeofadministrationandsupervisionofthesandexcavationintheYangtzeRiverwithintheirrespectiveadministrativeareasinaccordancewiththeseRegulations.第二条在长江宜宾以 下干流河道内从事开采砂石 （以下简称长江采砂）及其 管理活动的，应当遵守本条 例。第三条国务院水行政 主管部门及其所属的长江水 利委员会应当加强对长江采 砂的统一管理和监督检查， 并做好有关组织、协调和指 导工作。长江采砂管理，实行地方人 民政府行政首长负责制。沿 江县级以上地方人民政府应 当加强对本行政区域内长江 采砂活动的管理，做好长江 采砂的组织、协调和监督检 查工作。沿江县级以上地方人民政府 水行政主管部门依照本条例 的规定，具体负责本行政区 域内长江采砂的管理和监督 检查工作。国务院交通行政主管部门所 属的长江航务管理局负责长 江航道管理工作，长江海事 机构负责长江交通安全的监TheYangtzeRiverShippingAffairsAdministrationofthecompetentcommunicationsadministrativedepartmentoftheStateCouncilisresponsiblefornavigationadministrationoftheYangtzeRiver.TheYangtzeRiverMaritimeAffairsAdministrationisresponsibleforthesupervisionandadministrationofnavigationsafetyoftheYangtzeRiver.ThepublicsecuritydepartmentisresponsibleforthepublicsecurityoftheYangtzeRiver,andforcrackingdowncriminalactsinactivitiesofthesandexcavationintheYangtzeRiveraccordingtothelaw.Article 4 TheStateinstitutesaunifiedplanningsystemforthesandexcavationintheYangtzeRiver.TheplanforthesandexcavationintheYangtzeRivershallbecompiledbytheYangtzeRiverConservancyCommissionjointlywiththecompetentwateradministrativedepartmentsofthepeople'sgovernmentsofSichuanProvince,HubeiProvince,HunanProvince,JiangxiProvince,AnhuiProvinceandJiangsuProvince,ChongqingMunicipalityandShanghaiMunicipalityandsubmittedforapprovaltothecompetentwateradministrativedepartmentoftheStateCouncil,afterseekingcommentsfromtheYangtzeRiverShippingAffairsAdministrationandtheYangtzeRiverAffairsMaritimeAdministration,andthecompetentwateradministrativedepartmentoftheStateCouncilshallsolicitthecommentsofthecompetentcommunicationsadministrativedepartmentoftheStateCouncilpriortotheapproval.TheplanforthesandexcavationintheYangtzeRiveronceisapproved,itmustbestrictlyimplemented;ifanyamendmentisneeded,theapprovalshallbeobtainedinaccordancewiththeprovisionsoftheprecedingparagraph.督管理工作。公安部门负责 长江水上治安管理工作，依 法打击长江采砂活动中的犯 罪行为。第四条国家对长江采 砂实行统一规划制度。长江采砂规划由长江水利委 员会会同四川省、湖北省、 湖南省、江西省、安徽省、 江苏省和重庆市、上海市人 民政府水行政主管部门编 制，经征求长江航务管理局 和长江海事机构意见后，报 国务院水行政主管部门批 准。国务院水行政主管部门 批准前，应当征求国务院交 通行政主管部门的意见。长江采砂规划一经批准，必 须严格执行；确需修改时， 应当依照前款规定批准。长江采砂规划批准实施前， 长江水利委员会可以会同沿 江省、直辖市人民政府水行 政主管部门、长江航务管理 局和长江海事机构确定禁采 区和禁采期，报国务院水行PriortotheapprovalandimplementationoftheplanforthesandexcavationintheYangtzeRiver,theYangtzeRiverConservancyCommissionshalldefineexcavationforbiddenareasandexcavationforbiddenperiodsjointlywiththecompetentwateradministrationsofthepeople'sgovernmentsoftheprovincesormunicipalitiesdirectlyundertheCentralGovernmentalongtheRiver,theYangtzeRiver政主管部门批准。ShippingAffairsAdministrationandtheYangtzeRiverMaritimeAffairsAdministration,andsubmitthemtothecompetentwateradministrativedepartmentoftheStateCouncilforapproval.Article 5 TheplanforthesandexcavationintheYangtzeRivershalltakeintofullaccountoftherequirementsofsafetyoffloodprotectionandnavigationoftheYangtzeRiver,andcomplywiththecomprehensiveplanfor
