大连市外商投资促进条例RegulationofDalianCityonthePromotionofForeignInvestment制定机关：大连市人大(含常委会)发文字号：大连市人民代表大会常务委员会公告第11号批准机关：辽宁省人大(含常委会)批准日期:2023.09.27公布日期：2023.10.09施行日期：2023.12.01效力位阶：设区的市地方性法规法规类别：外商投资企业综合规定IssuingAuthority：DalianMunicipalPeople'sCongress(inchStandingCommittee)DocumentNumber：AnnouncementNo.11oftheStandingCommitteeofthePeople'sCongressofDalianCityApprovingAuthority：LiaoningProvincePeople,sCongress(incl.StandingCommittee)DateApproved：09-27-2023DateIssued：10-09-2023EffectiveDate：12-01-20231.evelofAuthority：LocalRegulationsOfDistrictedCities大连市人民代表大会常务委员 会公告AreaofLaw：GeneralProvisionsonForeign-FundedEnterprisesAnnouncementoftheStandingCommitteeofthePeople,sCongressofDalianCity(No. 11)大连市外商投资促进条例业经2023年8月29日大连市第十七届人民代表大会常务委员会第十三次会议通过，2023年9月27日辽宁省第十四届人民代表大会常务委员会第五次会议批准，现予公布，自2023（第十一号）TheRegulationofDalianCityonthePromotionofForeignInvestment,asadoptedatthe13rdSessionoftheStandingCommitteeoftheSeventeenthPeople'sCongressofDalianCityonAugust29,2023,andapprovedatthe5thSessionoftheStandingCommitteeoftheFourteenthPeople'sCongressofLiaoningProvinceonSeptember27,2023,isherebyissuedandshallcomeintoforceonDecemberl,2023.年12月1日起施行。大连市人民代表大会常务委员 会StandingCommitteeofthePeople'sCongressofDalianCityOctober9,20232023年10月9日RegulationofDalianCityonthePromotionofForeignInvestment大连市外商投资促进条例(Adoptedatthe13rdSessionoftheStandingCommitteeoftheSeventeenthPeople,sCongressofDalianCityonAugust29,2023,andapprovedatthe5thSessionoftheStandingCommitteeoftheFourteenthPeople'sCongressofLiaoningProvinceonSeptember27,2023)（2023年8月29日大连市第十七届人民代表大会常务委员会第十三次会议通过2023年9月27日辽宁省第十四届人民代表大会常务委员会第五次会议批准）Article1Forthepurposesofpromotingforeigninvestment,advancinghigher-levelopeningupofthisCity,andachievinghigh-qualitydevelopment,thisRegulationisdevelopedinaccordancewiththeForeignInvestmentLawofthePeople'sRepublicofChina,theRegulationontheImplementationoftheForeignInvestmentLawofthePeople'sRepublicofChina,andotherlawsandadministrativeregulationsandinlightoftheactualcircumstancesofthisCity.Article2ThisRegulationshallapplytotheforeigninvestmentpromotionactivitieswithintheadministrativeareaofthisCity.第一条为了促进外商投资，推动本市更高水平对外开放，实现高质量发展，根据中华人民共和国外商投资法中华人民共和国外商投资法实施条例等法律、行政法规，结合本市实际，制定本条例。第二条本市行政区域内的外商投资促进活动，适用本条例。Article3ThisCityshallcomprehensivelyimplementthesystemofpre-accessnationaltreatmentplusthenegativelistmanagementforforeigninvestment.Inthefieldsotherthanthose第三条本市全面落实外商投资准入前国民待遇加负面清单管理制度。在外商投资准入负面清单之外的领域，市、区（市）县人民政府及其部门 不得针对外商投资设置准入限 制或者禁止性措施。onthenegativelistforforeigninvestmentaccess,thepeople'sgovernmentsofthecity,districts(prefectures)andcountiesandtheirdepartmentsshallnotsetrestrictiveorprohibitivemeasuresfortheaccessofforeigninvestment.本市根据国家规定，在设立、 运营、处置等各阶段给予外国 投资者及其投资不低于类似情 形下给予本国投资者及其投资 的待遇。ThisCityshall,accordingtotheprovisionsissuedbythestate,accordtoforeigninvestorsandtheirinvestmentsthetreatmentnolessfavorabletothataccordedtodomesticinvestorsandtheirinvestmentsunderthesamecircumstancesatthestagesofestablishment,operation,anddisposition,amongothers.第四条本市按照国家对 外开放总体部署，对标高标准 国际投资贸易通行规则，推进 从商品和要素流动型开放向规 则、规制、管理、标准等制度 型开放拓展，不断增强区域门 户开放功能，加快建成东北亚 国际航运中心、东北亚国际物 流中心、区域性金融中心，打 造面向东北亚开放合作新前 沿。Article4ThisCityshall,inaccordancewiththenationaloverallarrangementsforopeningup,bebenchmarkedagainsttheprevailingrulesforhigh-standardinternationalinvestmentandtrade,advancetheexpansionfromthegoodsandelementsflow-basedopeninguptoinstitutionalopeningupbasedonrules,regulations,managementandstandards,amongothers,continuouslyenhancetheregionalopen-doorfunctions,acceleratetheestablishmentoftheNortheastAsiaInternationalShippingCenter,theNortheastAsiaInternationalLogisticsCenter,andtheregionalfinancialcenter,andbuildanewfrontierforopeninguptoandcooperationwithNortheastAsia.第五条市及区（市）县 人民政府应当加强对外商投资 促进工作的领导，制定外商投 资促进政策措施，建立健全外 商投资协调机制，及时协调、 解决外商投资工作中的重大问 题。Article5Thepeople,sgovernmentsofthecity,districts(prefectures)andcountiesshallstrengthentheleadershipofforeigninvestmentpromotion,developpoliciesandmeasuresforforeigninvestmentpromotion,establishandimproveforeigninvestmentcoordinationmechanisms,andcoordinateandsolvemajorproblemsintheworkconcerningforeigninvestmentinatimelymanner.市人民政府商务、发展改革主 管部门按照职责分工，负责本 行政区域内外商投资促进工 作；区（市）县人民政府主管 外商投资促进工作的部门，负 责本行政区域内外商投资促进 工作。Thecommercedepartmentandthedevelopmentandreformdepartmentofthepeople'sgovernmentofthecityshall,accordingtothedivisionoftheirfunctions,beresponsiblefortheforeigninvestmentpromotionworkwithintheirrespectiveadministrativeregions;andthedepartmentsinchargeofforeigninvestmentpromotionofthepeople,sgovernmentsofdistricts(prefectures)andcountiesshallberesponsiblefortheforeigninvestmentpromotionworkwithintheirrespectiveadministrativeregions.市及区（市）县人民政府其他 有关部门在各自职责范围内， 做好与外商投资促进相关的工 作。Otherrelevantdepartmentsofthepeople'sgovernmentsofthecity,districts(prefectures)andcountiesshall,withinthescopeoftheirrespectivefunctions,eff
