1/7中华人民共和国学位条例（2004修订）发文机关：全国人民代表大会常务委员会发布日期,2004.08.28Promulgatedby：StandingCommitteeoftheNationalPeople'sCongressPromulgationDate：2004.08.28生效日期:2004.08.28EffectiveDate：2004.08.28时效性：现行有效ValidityStatus：valid文号:主席令第二十七号DocumentNo.：中华人民共和国学位条例RegulationsofthePeople'sRepublicofChinaonAcademicDegrees(Revised)（1980年2月12日第五届全(Adoptedatthe13thMeetingoftheStandingCommitteeofthe国人民代表大会常务委员会第十三FifthNationalPeople'sCongressandpromulgatedbyOrderNo.4oftheStandingCommitteeoftheNationalPeople'sCongresson次会议通过根据2004年8月28February12,1980;andamendedinaccordancewiththeDecision日第十届全国人民代表大会常务委onAmendingtheRegulationsofthePeople'sRepublicofChinaonAcademicDegreesadoptedatthe11thMeetingoftheStanding员会第十一次会议关于修改中CommitteeoftheTenthNationalPeople'sCongressonAugust28,华人民共和国学位条例的决定2004)修正）第一条为了促进我国科学专Article1TheseRegulationsareformulatedforthepurposeofpromotingthegrowthofspecializedpersonnel,helpingto门人才的成长，促进各门学科学术raisetheacademiclevelofvariousbranchesoflearningand水平的提高和教育、科学事业的发promotingthedevelopmentofeducationandscienceinourcountry,inordertomeettheneedsofthesocialist展，以适应社会主义现代化建设的modernization.需要，特制定本条例。第二条凡是拥护中国共产党Article2AnycitizenwhosupportstheleadershipoftheCommunistPartyofChinaandthesocialistsystemandhas的领导、拥护社会主义制度，具有attainedcertainacademicstandardsmayapplyforan一定学术水平的公民，都可以按照appropriateacademicdegreeinaccordancewiththeprovisionsoftheseRegulations.®WoltersKluwer威科先行Q法律信息库本条例的规定申请相应的学位。第三条学位分学士、硕士、博士三级。Article 3 Academic degrees shall be of three grades: the bachelor's degree, the master's degree and the doctor's degree.第四条高等学校本科毕业 生，成绩优良，达到下述学术水平 者，授予学士学位：（一）较好地掌握本门学科的 基础理论、专门知识和基本技能；Article 4 The bachelor's degree shall be conferred on graduates from institutions of higher learning who have good academic records and have attained the following academic standards: (1) having a relatively good grasp of basic theories, specialized knowledge and basic skills in the discipline concerned; and(2) having initially acquired the ability to undertake scientific research or to engage in a special technical work.（二）具有从事科学研究工作或担负专门技术工作的初步能力。第五条高等学校和科学研究机构的研究生，或具有研究生毕业Article 5 The master,s degree shall be conferred on postgraduates in institutions of higher learning or scientific research institutes or persons with qualifications equivalent同等学力的人员，通过硕士学位的课程考试和论文答辩，成绩合格，达到下述学术水平者，授予硕士学位：to postgraduates on graduation, who have passed examinations in the required courses for the master's degree and successfully defended their dissertations and have attained the following academic standards: (1) having a firm grasp of basic theories and systematic, specialized knowledge in the discipline concerned; and（-）在本门学科上掌握坚实的基础理论和系统的专门知识；(2) having the ability to undertake scientific research or independently to engage in a special technical work.（二）具有从事科学研究工作或独立担负专门技术工作的能力。第六条高等学校和科学研究Article6Thedoctor'sdegreeshallbeconferredonpostgraduatesininstitutionsofhigherlearningorscientificGW工JTb“researchinstitutesorpersonswithqualificationsequivalent机构的研究生，或具有研究生毕业mmtopostgraduatesongraduation,whohavepassed同等学力的人员，通过博士学位的examinationsintherequiredcoursesforthedoctor'sdegreeB”,、HV、&q,士人-andsuccessfullydefendedtheirdissertationsandhave课程考试和论文答辩，成绩合格，attainedthefollowingacademicstandards:(1)havingafirm达到下述学术水平者，授予博士学andcomprehensivegraspofbasictheoriesandprofoundandsystematicspecializedknowledgeinthedisciplineconcerned;位：(2) havingtheabilitytoundertakeindependentscientificresearch;(一)在本门学科上掌握坚实and宽广的基础理论和系统深入的专门知识；(3) havingmadecreativeachievementsinscienceorinaspecialtechnology.（二）具有独立从事科学研究工作的能力；（三）在科学或专门技术上做出创造性的成果。第七条国务院设立学位委员 会，负责领导全国学位授予工作。 学位委员会设主任委员一人，副主 任委员和委员若干人。主任委员、 副主任委员和委员由国务院任免。第八条学士学位，由国务院 授权的高等学校授予；硕士学位、 博士学位，由国务院授权的高等学 校和科学研究机构授予。授予学位的高等学校和科学研Article1TheStateCouncilshallestablishanAcademicDegreesCommitteetodirecttheworkofconferringacademicdegreesthroughoutthecountry.TheAcademicDegreesCommitteeshallconsistofachairman,vice-chairmenandothermembers.Thechairman,vice-chairmenandothermembersshallbeappointedandremovedbytheStateCouncil.Article8Thebachelor'sdegreeshallbeconferredbythoseinstitutionsofhigherlearningauthorizedbytheStateCouncil.Themaster'sanddoctor,sdegreesshallbeconferredbythoseinstitutionsofhigherlearningandscientificresearchinstitutesauthorizedbytheStateCouncil.Alistofinstitutionsofhigherlearningandscientificresearchinstitutesthatmayconferacademicdegrees(hereinafterreferredtoas"degree-conferringunits")andthedisciplinesinwhichacademicdegreesmaybe，PAuqconferredshallbesubmittedtotheStateCouncilbyitsAcademic究机构（以下简称学位授予单位）DegreesCommitteeforapprovalandpromulgation.及其可以授予学位的学科名单，由国务院学位委员会提出，经国务院批准公布。第九条学位授予单位，应当 设立学位评定委员会，并组织有关 学科的学位论文答辩委员会。学位论文答辩委员会必须有外 单位的有关专家参加，其组成人员 由学位授予单位遴选决定。学位评Article9Eachdegree-conferringunitshallestablishanacademicdegreeevaluationcommitteeandformdissertationcommitteesforthedisciplin
