DecisionoftheStateCouncilonAmeIIdingCertainAdministrativeRegulationandDecisionsoftheStateCouncilDocumentNumber：OrderNo.771oftheStateCouncilofthePeople'sRepublicofChinaAreaofLaw:Sort-OutofRegulationsandRules1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：StateCouncilDateIssued：01-13-2024EffectiveDate：01-13-2024Status:EffectiveOrderoftheStateCouncilofthePeople'sRepublicofChina(No.771)TheDecisionoftheStateCouncilonAmendingCertainAdministrativeRegulationandDecisionsoftheStateCouncil,asadoptedatthe21stexecutivemeetingoftheStateCouncilonDecember18,2023,isherebyissued,andshallcomeintoforceonthedateofissuance.Premier:LiQiangJanuary13,2024DecisionoftheStaleCouncilonAmendingCertainAdministrativeRegulationandDecisionsoftheStateCouncilAccordingtotherequirementsofthePlanfortheInstitutionalReformofthePartyandtheState,theStateCouncilhasreviewedtheadministrativeregulationstobeamended中华人民共和国国务院令（第771号）国务院关于修改部分行政法规和国务院决定的决定已经2023年12月18日国务院第21次常务会议通过，现予公布，自公布之日起施行。总理李强2024年1月13日国务院关于修改部分行政法规和国务院决定的决定根据党和国家机构改革方案要求，为保障行政法规体系的一致性、规范性和时效性，加快转变政府职能，国务院对机构改革涉及需修改的行政法规进行了清理。经清involvedintheinstitutionalreform,forthepurposesofguaranteeingtheconsistency,standardizationandtimelinessoftheadministrativeregulationsystem,andacceleratingthetransformationofgovernmentfunctions.Uponreview,theStateCouncilherebydecidestoamendcertainclausesofoneadministrativeregulationandtwodecisionsoftheStateCouncil:I.OnearticleisaddedintheRegulationontheMonetaryPolicyCommitteeofthePeople'sBankofChinaasArticle2:tinthework,theMonetaryPolicyCommitteeshallinsistontheleadershipoftheCommunistPartyofChina,promoteandimprovethemodemmonetarypolicyframework,andreportimportantmatterstotheCPCCentralCommitteeandtheStateCouncil.,Article 5 isrenumberedasArticle6andamendedtoread:“TheMonetaryPolicyCommitteeshallbecomposedofthefollowingentitiesandpersons:“theGovernorofthePeople'sBankofChina;“oneDeputySecretary-GeneraloftheStateCouncil;4toneDeputyDirectorGeneraloftheNationalDevelopmentandReformCommission;4*oneViceMinisterofFinance;55理，国务院决定对1部行政法规和2个国务院决定的部分条款予以修改：一、在中国人民银行货币政策委员会条例中增加一条，作为第二条：“货币政策委员会工作坚持中国共产党的领导，推动健全现代货币政策框架，重要事项报党中央、国务院。”将第五条改为第六条，修改为：“货币政策委员会由下列单位和人员组成：“中国人民银行行长；“国务院副秘书长1人；“国家发展和改革委员会副主任1人；“财政部副部长1人；“twoDeputyGovernorsofthePeople,sBankofChinaf'“中国人民银行副行长2人;“theDirectoroftheStateAdministrationforFinancial“国家金融监督管理总局局长;Regulation;"“theChairmanoftheChinaSecuritiesRegulatoryCommissionf,“theDirectoroftheNationalBureauofStatistics;',“theDirectoroftheStateAdministrationofForeignExchange;*'“theHeadoftheChinaBankingAssociation;and”“threeexpertcommitteemcmbers.“TheadjustmenttotheentitiesandpersonsofwhichtheMonetaryPolicyCommitteeiscomposedshallbedecidedbytheStateCouncil?'Article 6 isrenumberedasArticle7andamendedtoread:“TheMonetaryPolicyCommitteeincludesexofficiomembersandnomineemembers.TheGovernorofthePeople'sBankofChina,theDirectoroftheStateAdministrationforFinancialRegulation,theChairmanoftheChinaSecuritiesRegulatoryCommissionandtheDirectoroftheStateAdministrationofForeignExchangeareexofficiomembersoftheMonetaryPolicyCommittee.Asnomineemembers,othermembersoftheMonetaryPolicyCommitteeshallbenominatedbythePeople'sBankofChinaorbythePeople'sBankofChina,upon“中国证券监督管理委员会主席；“国家统计局局长；“国家外汇管理局局长；“中国银行业协会会长；“专家委员3人。“货币政策委员会组成单位和人员的调整，由国务院决定。”将第六条改为第七条，修改为：“货币政策委员会委员包括当然委员和提名委员。中国人民银行行长、国家金融监督管理总局局长、中国证券监督管理委员会主席、国家外汇管理局局长为货币政策委员会的当然委员。货币政策委员会其他委员为提名委员，其人选由中国人民银行提名或者中国人民银行商有关部门提名，报请国务院任命。”consultationwiththerelevantdepartments,andbereportedtotheStateCouncilforappointment.Article 8 isrenumberedasArticle9,andinitem(3),44monetaryandbankingisreplacedwith“finance.”Article 9 isrenumberedasArticle10andamendedtoread“AnexpertcommitteememberoftheMonetaryPolicyCommitteeshall,inadditiontotheconditionsprovidedforinArticle9ofthisRegulation,meetthefollowingconditions:tt(1)Heorshehasaseniorprofessionalandtechnicaltitle,hasbeenengagedineconomicandfinancialworkfornotlessthan1()years,andhasrelativelyhighacademiclevel.*(2)Heorsheisnotapublicsen,antofthestateorworksforanyfbr-profitinstitution?,Article 10 isrenumberedasArticle11andamendedtoread:“ThetermofofficeoftheHeadoftheChinaBankingAssociationamongmembersoftheMonetaryPolicyCommitteeshallusuallynotexceedfiveyears;andthetermofofficeofanexpertcommitteemembershallnotexceedthreeyears,andanexpertcommitteemembershallnotberetainedformorethantwoconsecutiveterms.”Article 11 isrenumberedasArticle12,inwhichoneitemisaddedasitem(3):tt(3)ThetcnofofficehasexpiredinaccordancewiththeprovisionsofArticle11ofthisRegulation.将第八条改为第九条，将第三项中的“货币、银行”修改为“金融”。将第九条改为第十条，修改为：“货币政策委员会中的专家委员除应当符合本条例第九条规定的条件外，还应当具备下列条件：“（一）具有高级专业技术职称，从事经济金融工作10年以上，具有较高的学术水平：“（二）非国家公务员，并且不在任何营利性机构任职。”将第十条改为第十一条，修改为：“货币政策委员会委员中的中国银行业协会会长任期一般不超过5年；专家委员一届任期不超过3年，最长任期一般不超过两届。”将第十一条改为第十二条，增加一项，作为第三项:“（三）依照本条例第十一条规定任期已满的”。Item(1)ofArticle15isamendedtoread:*(1)Understandingtheeconomic,financialandmonetary
