MeasuresforthePublicSecurityAdministrationoftheHotelIndustry(2022Revision)DocumentNumber：OrderNo.752of(heStateCouncilofthePeople'sRepublicofChinaAreaofLawPublicSecurityAdministration1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：StateCouncilDateIssued：03-29-2022EffectiveDale：05-01-2022Status:Effective2020-2022AnnotationVersion2011-2020AnnotationVersion1987-2011AnnotationVersionMeasuresforthePublicSecurityAdministrationoftheHotelIndustry(ApprovedbytheStateCouncilonSeptember23,1987,andpromulgatedbytheMinistryofPublicSecurityonNovember10,1987;revisedinaccordancewiththeDecisionoftheStateCouncilonAbolishingandAmendingSomeAdministrativeRegulationsonJanuary8,2011;revisedforthesecondtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonNovember29,2020;andrevisedforthethirdtimeinaccordancewiththeDecisionoftheSlateCounciltoAmendandRepealCertainAdministrativeRegulationsonMarch29,2022)Article1TheseMeasuresareformulatedtosafeguardthenormalbusinessoperationsofthehotelindustrytoensurethesafetyofthelivesandbelongingsofguestsandtomaintainpublicsecurity.旅馆业治安管理办法（1987年9月23日国务院批准1987年11月10日公安部发布根据2011年1月8日国务院关于废止和修改部分行政法规的决定第一次修订根据2020年11月29日国务院关于修改和废止部分行政法规的决定第二次修订根据2022年3月29日国务院关于修改和废止部分行政法规的决定第三次修订）第一条为了保障旅馆业的正常经营和旅客的生命财物安全，维护社会治安，制定本办法。第二条凡经营接待旅客住宿的旅馆、饭店、宾馆、招待所、客货栈、车马店、浴池等（以下统称旅 馆），不论是国营、集体经营，还是合伙经营、个体经 营、外商投资经营，不论是专营还是兼营，不论是常年经 营，还是季节性经营，都必须遵守本办法。Article2Allrestaurants,hotels,guesthouses,hostels,passengerandcargostop-overstations,inns,publicbathhouses,etc.(hereinafterreferredtoashotels),whichprovideaccommodationtoguestsshallcomplywiththeseMeasures,regardlessofwhethertheyareStaleoperated,collectivelyoperated,partnershipoperated,individuallyoperated,orforeign-funded,orwhethertheyareexclusivelyorsimultaneouslyoperated,orwhethertheyareexclusivelyorsimultaneouslyoperatedorwhethertheyareoperatedallyearroundorseasonallyoperated.第三条开办旅馆，要具备必要的防盗等安全设 施。第四条 申请开办旅馆，应取得市场监管部门核发 的营业执照，向当地公安机关申领特种行业许可证后，方 准开业。Article 3 Fortheestablishmentofahotel,thenecessaryantitheftandothersafetyfacilitiesshallbeinplace.Article 4 Fortheestablishmentofahotel,theapplicantshallobtainabusinesslicenseissuedbytheadministrationformarketregulation,andthehotelmayopenforbusinessonlyaftercollectingaspecialindustrypermitfromthelocalpublicsecurityorganuponapplication.经批准开业的旅馆，如有歇业、转业、合并、迁移、改变名称等情况，应当在市场监管部门办理变更登记后3 Fl 内，向当地的县、市公安局、公安分局备案。第五条 经营旅馆，必须遵守国家的法律，建立各Ifahotelwhichhashaditsoperationsapproved,wishestosuspendoperations,changeitslineofbusiness,amalgamate,movetoanotherlocation,changeitsnameorothersuchmatters,itshallreportthedetailstothelocalcountyormunicipalsecuritybureauorbranchbureauforfilingwithinthreedaysofregisteringthechangewiththeadministrationformarketregulation.Article 5 HoteloperatorsshallabidebyStatelaws,establishasafetycontrolsystemforthevariousrelevantitemsand项安全管理制度，设置治安保卫组织或者指定安全保卫人provideapublicsecurityorganisationorassignsafetyprotectionpersonnel.员。Article6Ahotelshallregistergueststowhomaccommodationisprovided.Whenregistering,theguest'sidentificationcardshallbeexaminedandanaccurateregistrationofallstipulateditemsshallbemade.Ifaccommodationisprovidedtoaforeignguest,theaccommodationregistrationformshallbesubmittedtothelocalpublicsecurityorganwithin24hoursoftheguest'sarrival.Article7Ahotelshallprovidestorageboxes,storeroomsorsafesforaguest'sbelongingsandshallspeciallyassignpersonneltotakecareofthesebelongings.Asystemforregistration,receivalandhand-overofpropertycheckedinbyaguestshallbeestablished.Article8Ahotelshallmakeappropriatearrangementstolookafterpropertyleftbehindbyaguest.Ifunabletobereturnedtotheoriginalownerornotclaimedwithinthreemonthsofannouncingthefindingoflostproperty,alistofthegoodsshallbecompiledandregisteredandsenttothelocalpublicsecurityorganforhandlingaslostproperty.Contrabandandquestionablegoodsshallbereportedpromptlytothepublicsecurityorganforhandling.Article9Ifhotelpersonneldiscoversomeoneviolatingthe第六条旅馆接待旅客住宿必须登记。登记时，应当查验旅客的身份证件，按规定的项目如实登记。接待境外旅客住宿，还应当在24小时内向当地公安机关报送住宿登记表。第七条旅馆应当设置旅客财物保管箱、柜或者保管室、保险柜，指定专人负责保管工作。对旅客寄存的财物，要建立登记、领取和交接制度。第八条旅馆对旅客遗留的物品，应当妥为保管，设法归还原主或揭示招领；经招领3个月后无人认领的，要登记造册，送当地公安机关按拾遗物品处理。对违禁物品和可疑物品，应当及时报告公安机关处理。第九条旅馆工作人员发现违法犯罪分子，行迹可law,behavingsuspiciouslyoranoffenderwantedbythepublic疑的人员和被公安机关通缉的罪犯，应当立即向当地公安securityorgans,themattershallbereportedimmediatelytothelocalpublicsecurityorgan.Concealingknowledgeofacaseorharbouringanoffendershallnotbepermitted.Article10Ifahotelopensplacesofpublicentertainmentandservicesuchasdancehallsandmusicandteahouses,inadditiontoimplementingtherelevantprovisionsoftheseMeasures,administrationshallalsobecarriedoutinaccordancewiththerelevantprovisionsoftheStateandlocalgovernment.Article 11 Guestsshallbeprohibitedfrombringingcombustible,explosive,acutelypoisonous,corrosive,radioactiveandotherdangerousarticlesintoahotel.Article 12 P
